ITA Assists Hurricane Victim During the Holidays

Thanks to the generosity of our supporters, the ITA was able to provide holiday assistance to a number of deserving individuals and families recently.

One of those was Petty Officer, Second Class Matthew Whitney of the US Coast Guard. Officer Whitney lose most of his possessions while he was stationed in New Orleans during Hurricane Katrina. MCI Leader and ITA Board Member Tim Buffum presented Whitney with Wal-Mart Gift Cards to assist him in his rebuilding efforts. Whitney is the son of longtime ITA member Peru Trooper Ron Whitney and wife, Lennie.

Peru State Police Post Has New Commander

ISP Superintendent Paul E. Whitesell recently announced the promotion of Sgt. Mike Nichols to the rank of Lieutenant. In his new assignment, Nichols will serve as the District Commander for the Peru State Police Post, District 16, which covers Miami, Fulton, Cass, Howard, Wabash and Tipton Counties.

Nichols is a 17-year veteran of the department and began his career at the Peru Post as a road trooper in Howard County. He was promoted to Sergeant in 1994 and has worked as a Sergeant in both the Training & Commercial Vehicle Enforcement Divisions. Nichols also served as a member of the Explosive Ordinance Disposal Team.

He is a graduate of IU with a degree in Criminology. A resident of Tipton County, he has two daughters, Khaila and Kinsey.


ISP Cautions Citizens on Possible Holiday Scams

During the holiday season, the Hoosier spirit is strong and we go to great extremes to reach out and help those in need. Many Hoosiers are giving their money, time and labor. However, some people are not in the holiday spirit and will take advantage of good-hearted Samaritans by setting up false charitable groups to scam money from them. Please make sure you are donating your money to reputable organizations.

Tips before Donating:
Listen carefully to what they tell you. Get the name of the person to whom you are speaking, as well as the name and address of the organization. Make sure the organization is not using a name similar to that of a well-known organization.
Ask before agreeing to donate any money how the donation will be used. Ask about the programs the organization has provided recently. You may also ask for brochures or other information be mailed to your home. Legitimate charities will welcome your questions. They want people to know what they are doing in the community.
Learn more about the organization. Check out their website or their materials. Talk to someone at their Corporate Office.
Finally, never give out your credit card or send cash in the mail. Write your check to the organization - never to an individual.

Pennsylvania State Trooper Slain

Sympathy is extended to the family of Cpl. Joseph Pokorny of the Pennsylvania State Police. Pokorny, 45, was found shot to death in the parking lot of the Extended Stay Hotel in Carnegie, PA. Suspects are in police custody after a massive manhunt in the area. Pokorny had served the state police for 22 years.


Peru Troopers Honored for Service

Three Peru ISP officers have been recently honored for their continued excellent service to their community.
Master Trooper Randy Shaver of Fulton County, Sgt. Rick Brown and Detective Sgt. Tim Miller, both of Miami County, all received 20 year service awards.

Shaver patrols Fulton and Wabash Counties, while Brown supervised 10 troopers in Cass and Miami Counties. Miller is assigned to the Criminal Investigations Division and supervised 4 Peru Post Detectives.

The awards were presented by acting District Commander, Lonie Slisher. State Troopers are recognized every five years for their service years.


ITA Lawsuit With Former President Settled

The ITA has reached an out of court settlement between former ITA President Michael A. Nufer and his private business, DLMD, Inc. While the terms of the settlement are confidential, the agreement reached was acceptable to both parties.

The ITA thanks our members and friends for their support during the past two years and looks forward to returning our primary focus to our mission statement and our two goals of supporting those who serve with pride and lending a helping hand to those in need.

California Highway Patrol Officer Fatally Shot

Sympathy is extended to the family of CHP Officer Andy Stevens, 37, a 13-years veteran who was a commercial vehicle inspector. Stevens was married with no children. Stevens was shot Thursday during a traffic stop and a bystander called in the shooting using the officer's squad car radio. More than 300 law enforcement officers are combing the area, vowing not to stop until the killer is found.


ITA Settles Lawsuit with Former President

An out of court settlement has been reached between former ITA President Michael A. Nufer and the ITA. The terms of the settlement are confidential. The following article, which was not submitted by the association, was published in the Steuben County Herald Republican Newspaper on Friday, November 10, 2005:

ANGOLA---A suit that pitted Indiana State Trooper Michael Nufer and his private company against the Indiana Troopers Association has been settled.

A bench trial scheduled for Monday and Tuesday did not occur after the ITA’s attorney, Allen Stout, announced to Steuben Circuit Court last Thursday the proceedings would not be necessary.

The case was officially settled Nov. 4, said Stout. “The terms of the settlement are confidential, however both parties, Nufer and the ITA, agreed to the settlement as a satisfactory resolution of their claims and counterclaims,” Stout said. Nufer’s Auburn attorney W. Erik Weber was contacted Thursday, but was not available for comment. Attempts to locate Nufer were not successful.

Nufer had been asking for a total of $133,118.72 — which included $56,000 in lost rent and $63,000 in lost wages.

Nufer claimed he was wrongfully terminated from the ITA, for which he served as president from March 21, 1999 to Nov. 7, 2002. The ITA board voted to remove him from his position, stating “loss of patience with plaintiff’s rogue activities and misbehavior as president of the organization,” according to court documents.

The ITA countered Nufer’s claims by claiming a breach of fiduciary duty, criminal acts of forgery, fraud in implementation of a building lease, fraudulent inducement to execute a lease and conversion of the ITA’s assets. Criminal charges against Nufer have been investigated by the Angola Police Department.

While the ITA formerly operated out of a building at 130 W. Harcourt Road, owned by Nufer’s private corporation, DLMD Inc., it moved a couple of years ago to an office at 117 W. Maumee St., Angola.

Nufer filed suit in October 2003. He said his dismissal was not done by ITA bylaws, and claimed he was still technically the president and asked for back wages of $1,500 a month. He also claimed loss of rent through a lease between the ITA and Nufer after the nonprofit organization that provides benefits to Indiana State Police and their families moved downtown.

In various documents filed with the civil case, the ITA claims Nufer forged paperwork in acquiring a van and acquired $2,000 in commemorative coins with an ITA credit card. In addition, Nufer allegedly talked the board of directors into helping him refinance his Harcourt Road building by upping the rent from $1,800 to $2,500 for five years.

No criminal charges have been formally filed due to those claims, though Nufer is being investigated on potential charges through special prosecutor J. Everett Newman of the Noble County Prosecutor’s Office.

“The issue in this case is who is the victim as far as any potential charges,” said Newman Thursday. He was assigned to the case Aug. 31, 2004. On Aug. 23, 2004, a case was filed in Steuben Superior Court. While Nufer’s name does not appear on the brief documentation, Steuben County Prosecutor’s Office confirmed the case was related to the investigation of Nufer.

Newman said his job is to determine if Nufer “uttered a false instrument” with the intent to defraud someone, in this case either Nufer’s ex-wife or a bank. According to state law, Newman must file charges within two years of the alleged crime, which in this case would be some time this coming summer.

Another civil case is also pending against Nufer, filed by one of the employees of DLMD Inc. at Burton’s Laundry, which is on the back side of the building formerly occupied by the Troopers Association. Shirley Garner is asking for additional remuneration from Nufer from a fall Feb. 6, 2004 in the laundry parking lot. While DMLD’s insurance company provided worker’s compensation for medical expenses and time spent at appointments, Garner seeks further payment from Nufer himself. Nufer contends that she cannot make such a claim because he is the sole shareholder, president and manager of DLMD, hence, he has already dealt with the issue in that capacity.

A hearing in the case is set for Dec. 5 in Steuben Superior Court.


Memorial Services for Supt. Frank Jessup

Retired Superintendent Frank A. Jessup passed away November 3, 2005 in sun Lakes, Arizona. Memorial services will be conducted at 1:00 pm on November 16, 2005 at the Indiana State Police Youth Education & Historical Center, 8500 East 21st Street, Indianapolis, Indiana. The family will receive visitors immediately following the service at the Hilton Hotel, 8181 N. Shadeland Avenue, Indianapolis. A Department Memorial Box has been requested by the family.

Phyllis J. Hite Retirement Luncheon

ISP President Retires from Indiana State Police

After 26 years with the ISP, Sgt. Duane L. Davies has retired from the department.  Davies joined the ISP on December 14, 1979 and officially retired on June 16, 2005. 

On Thursday, September 29th, he was honored by the Ft. Wayne District 22 with a retirement gathering.  The event was held at the Eagle's Nest Event Center in Columbia City with over 100 fellow officers, family and friends in attendance.

Retirement gifts and sentiments were offered by the commanders of the North Region and the Ft. Wayne Post, as well as from the Indiana State Police Alliance and the ITA.

Ft. Wayne's ITA Board Member, David Lloyd, and Executive Director Ernie Alder made presentations on behalf of the ITA, which Davies has led for the past 3 years.  Lloyd shared a heartfelt thanks to Davies for the excellent leadership he has given to the ITA over the past few years.

Davies has expressed his desire to step down as ITA President feeling that the position needs to be filled by an active, uniformed officer.  The board of directors will address his request at their November meeting.

Congratulations, Sgt. Davies and thank you, for a job well done!


Missouri Loses Another Trooper in Accident

The Missouri Highway Patrol has once again grieves for another officer killed in the line of duty. Trooper Donald K. Floyd, 45, was working with the patrol's aircraft to catch speeders and had pulled over a car. He was struck by a passing truck as he turned to walk back to his patrol car.

His death marks the second time in just over a month a patrolman has been killed by a passing motorist in Missouri. He is the fourth Missouri Highway Patrol officer killed in the line of duty in 2005.

Please remember this family and remember to obey the "move over or slow down" law to protect our officers as they serve and protect all of us.

Arkansas State Trooper Dies

Trooper Mark W. Carthron, 31, of West Memphis, Arkansas died at 12:30am today after being struck by another troopers vehicle around 6:30pm on Sunday. 

The eight-year veteran of the department was picking up a spike strip that had been thrown down on I-40 to stop a robbery suspect when he was struck by another trooper's car.  The suspect was stopped by the spike strips. Carthron is survived by his wife, Angela, his parents and a brother. Please remember this family in your prayers.


ITA Offers Matching Funds for Katrina Troopers

The Board of Directors of the ITA have stepped forward to lend assistance to fellow troopers in Louisiana, Mississippi and Alabama who are displaced due to the recent wrath of Hurricane Katrina. Letters have been mailed to all active members, associate members, retirees and magazine supporters seeking donations.  The ITA will match all donations received, up to $15,000. Funds received by September 27th, will be matched and donated equally to the Trooper Associations in Louisiana, Mississippi, and Alabama.  All three states report numerous members of their departments who have lost their homes and/or family members during this crisis.

Anyone who wishes to donate to this fund may do so by sending their donation to the ITA at PO Box 798, Angola, Indiana 46703.  Checks should be designated for the Hurricane Katrina Law Enforcement Relief Fund

80th Birthday Celebration for Ret. Supt. Bob Konkle

Missouri State Highway Patrol Loses Another Officer

For the third time in 2005, the Missouri State Patrol is grieving the loss of one of their own. Cpl. John Sampietro, Jr. was killed on Wednesday after he was hit by a semi that crossed the median. He was doing an accident reconstruction report at the scene of a Monday night crash on I-44 near Strafford that killed two adults and two children from Indianapolis.

Sampietro, who leaves behind his wife, a radio operator for the patrol, and two young sons, had been with the patrol since 1992.

ISP Trooper Injured In "Move Over" Accident

An elderly driver failed to obey the "Move Over Law" and move to the next lane on Monday morning resulting in an accident near the 132-mile marker on I-69.

Trooper Wes Rowlader of District 22-Ft. Wayne had pulled over a van for a traffic stop, when the northbound driver failed to move over and clipped the trooper's car, causing it to flip over. Rowlader was pinned inside his car and was freed by emergency workers.
Both the trooper and the two elderly people in the car that hit him were airlifted to the hospital. Their injuries were not believed to be life-threatening, but Rowlader was kept overnight at the hospital for observation due to a head injury. He was listed in fair condition this morning.

So far this year, Rowlader is the third Ft. Wayne post trooper to be hurt while stopped on the side of the road.

State Police Seeks Public Assistance

Indiana State Police are asking the public to report suspicious activity around crop fields and outbuildings where the possibility of cultivating marijuana is suspected.
Marijuana eradication efforts by the ISP are underway throughout Indiana and will continue until late fall. Eradication officers have recently increased their focus on indoor growing operations.
Growing marijuana is a crime and is punishable by fines and imprisonment. Failure to report or destroy marijuana is also a crime.
According to police, marijuana growers typically grow their plants on other people's property and in farmer's crops.

Retired ISP Detective Clear Honored

Detective Herb Clear, 65, was honored this week with a Distinguished Hoosier Award from the Office of the Governor. Clear, from Monticello, gave 44 years of his life to law enforcement at the state and county level.

Clear began his career with the White County Sheriff's Department in 1961 and worked as a road deputy until 1964, when he joined the Indiana State Police. He was promoted to the Investigation Unit in 1974 and to the Special Homicide Team in 1988, where he served until his retirement from the West Lafayette Post in 1994. He then went to work for the prosecutor's office.

Clear was instrumental in solving many homicides and when he retired from the state police, there were 25 convicted murderers serving time in Indiana prisons because of his work.


Longtime ITA Member Promoted

The Indiana State Police has announced the promotion of Master Trooper Kevin Smith of Angola to Detective. Smith, a longtime loyal member of the ITA, has been with the state police since 1987, first assigned to the toll-road and later as a road patrol officer in Steuben County. He has also served as a crime scene technician for the Ft. Wayne Post Regional Laboratory. Smith will join the Criminal Investigation Division of the ISP responsible for conducting criminal investigations and providing assistance to other area agencies.

Cops Cycling for C.O.P.S. 2005 Tour - "We Ride For Those Who Died"

A group of Indiana police officers departed Indianapolis on Monday, June 20th for a bicycling tour of the state to visit with family members of officers killed in the line of duty in Indiana. They will also visit gravesites of Indiana officers during their tour. Each officer is riding the 1,000 mile trip on his own time to honor fallen officers. Each rider has raised funds through donations which will be given to the Indiana Chapter of COPS (Concerns Of Police Survivors).

On Friday, June 24th, the group will visit Angola, Indiana, the home of the ITA Corporate Office. A casual dinner will be provided by the ITA at Sutton's Deli in downtown Angola, where a number of area survivors will meet with the riders, friends and other local officers.

The tour will continue south on Saturday, June 25th and will conclude their ride around the perimeter of the state on Saturday, July 2nd in Indianapolis.

Donations received from the tour will provide financial assistance to family members of fallen officers by helping defray the costs associated with attending National Police Week held annually in May. Funds also assist survivors in attending seminars for children, siblings, parents, adult children and spouses of law enforcement officers to help them deal with their grief.
C.O.P.S. is a not for profit organization under section 501(c) 3 and all donations are tax deductible.

FBI Special Agent Robert Hardesty was killed in a training accident in Quantico, VA on June 2nd. Prior to joining the FBI, Hardesty was an Indiana State Excise Police Officer and a Porter County Sheriff's Deputy. Trooper Escapes Serious Injury in Traffic Stop

ISP Trooper Lionel "Andy" Smith escaped serious injury on Tuesday afternoon when he was dragged by his arm after a routine traffic stop in Steuben County.

Smith, assigned to District 22-Ft. Wayne, pulled over two vehicles after he saw them traveling at more than 90 mph on a rural road. One driver complied with his request and turned off his vehicle, but the other driver wrestled with Smith when he reached inside his pickup truck to turn it off. The driver then accelerated, dragging the trooper by the arm.

Smith fired several shots at the suspect, striking him once. The driver kept going for a short distance until he crashed into a barn. The driver received a gunshot wound to his head and was transported from the scene to a Ft. Wayne hospital via helicopter.
Both Trooper Smith and the driver's injuries were said to non-life threatening. In accordance with ISP policy, Smith is on administrative leave pending an investigation and felony charges of resisting law enforcement, battery to a police officer and criminal recklessness with a vehicle are pending against the truck driver.

Jennifer Robbins, 20-year old daughter of Lt. Gary Robbins, Commander of the Ft. Wayne ISP District 22 and stepdaughter of Sgt. Kathy Robbins, CID, Region 2, lost her courageous battle with cancer on Saturday, April 30th.

Calling for Jennifer will be Tuesday, May 3rd from 2 to 5pm and 7 to 9pm at Dale McComb & Sons Funeral Home, 8325 Covington Road, Ft. Wayne, Indiana. Services will be on Wednesday, May 4th, at 10 am at the funeral home with calling 1 hour before services. Burial will follow in Covington Memorial Gardens, 8408 Covington Rd. MOVE OVER OR SLOW DOWN!!

A reminder from the ITA to help keep our troopers safe on our highways, the "move over" law was passed by the General Assembly in 1999 requiring drivers to slow down and switch lanes whenever possible when approaching a stopped emergency or maintenance vehicle that has its lights flashing.
State police will mark the anniversary of Trooper Andrew Winzenread's death on April 25, 1997, by targeting motorists who do not obey this law. Winzenread was killed when he stopped to help a stranded motorist near Indianapolis.
Since that time, the Indiana State Police has lost six additional officers, four of them in traffic related accidents.
They were: Troopers Patrick Bartram, David Deuter, Richard Gaston, and Jason Beal. Troopers Cory Elson and Scott Patrick were shot to death.

In Memory of Our Fallen Brothers

Sympathy is extended to the families of two state troopers who have recently died. Services were held Monday in Orchards, Washington for Trooper Scott P. Piva, who died from unknown causes at his home in Amboy. He had joined the patrol in 1999 and leaves a wife and two children.

In Van Buren, Missouri, the Missouri Highway Patrol is grieving over the loss of Trooper Carl "Dewayne" Graham, Jr. who was found shot to death near his home. Graham's shift had just ended and he was still in his uniform when he was found. He leaves his father, Carl, Sr., a 4 year old son and his fiancée. Hours before his death, he had placed stakes at the building site of their future home.

Evansville Troopers OK Following Shootout

An ex-convict was killed Tuesday in a shootout that injured an Evansville trooper. The man shot at officers with an automatic weapon after crashing his car in a high-speed chase as Trooper Brent Clark attempted to stop him.

Trooper Clark, Master Trooper Roger Cannon and Knox County Sheriff's Major Mike Morris returned fire, killing the offender and wounding a passenger in his car.

During the shootout, a bullet passed through the front window of Trooper Jason Allen's car and struck him in the chest. ISP spokesman Sgt. Todd Ringle said Allen was wearing a bulletproof vest and was not seriously wounded. He was treated and released at a local hospital.

All three troopers are reported to be in good condition and are taking a few days off according to Ringle.


ISP Retired Supt. Konkle Recovery Update

Retired Supt. Konkle, who has been recovering from a fall in November, has been transferred to a Logansport health care facility to be near his daughter and her family.

Supt. Konkle, who will be 80 in September, suffered a fractured pelvis in the fall and has experienced complications since that time. He recently was transferred from St. Francis Hospital in Indianapolis to continue his recovery in Logansport.

2005 Membership Drive in Progress

The 2005 Membership Drive is in full swing. Renewal notices were mailed to all 2004 members in December and the response continues to be strong. 2005 David Deuter Memorial 5th Grade Essay Contest

Invitations were mailed on 2/4/05 to elementary schools statewide regarding the 2005 essay contest. Fifth graders are invited to compose an original essay on the subject, "What Being A Good Citizen Means To Me." The essays are to be approximately 100 words in length. One winner will be selected from each Indiana County. From the county winners, a statewide winner and four runners-up will be selected. Each county winner will receive a $100 US Savings Bond, engraved plaque, and a Shining Star Award from the Governor. The statewide winner will receive a $1,000 US Savings Bond and the runners up each receive a $500 bond. All county winners and their families will be invited to the Statewide Awards Program which will be held on Friday, June 10th, at the Indiana State House.


2005 College Scholarship Program

The Board of Directors of the ITA proudly announce to their members the 2005 College Scholarship Program. While detailed program guidelines are being mailed to each 2004-2005 member, the program invites ITA members with children in college to enroll their eligible child/children in the scholarship program no later than March 31, 2005. Students must be enrolled full-time (minimum of 12 hours) and must complete the January-June semester with a GPA of "C" or above. A per credit hour reimbursement will be paid to each student that satisfies the program requirements. Grade documentation must be received by the ITA no later than July 1, 2005. 2005 dues must be paid prior to enrollment in the program.


ITA 25th Anniversary Commemorative Rifle Raffle

As part of our 25th Anniversary celebrationin 2004, the ITA offered beautiful Winchester 94 Commemorative Rifles to our members, associate members and advertisers. The rifles are 30-30 calibers and are overlaid in 24-karat gold. They are embossed and engraved with historical ISP events and landmarks. While they are beautiful to behold, they do come with a $2,800 price tag.

At the present time, there are six of these models available. The ITA is now offering to our members - both active and retired - the opportunity to participate in a Rifle Raffle. Raffle criteria is being mailed to all 2004-2005 members. Tickets will be $50 each or 5 for $200. Only 100 tickets will be sold. All proceeds over and above the cost of the rifle will go into the ITA Line of Duty Death Benefit Fund. Active members 2005 dues must be paid in order to participate in the raffle.

Tickets will be sold from February 1 until April 1, 2005. The drawing will be held at the April 16th board of directors meeting at the YEHC in Indianapolis. You do not have to be present to win.
